Parshas Korach – Their Portion of the Tamid

 In this Parsha we learn about the Machlokes that Korach and his congregation have with Moshe. Moshe exerts super human efforts to forestall the consequences of their rebellion, and humbles himself to the point of personally going to beseech them to stop. When Dasan and Aviram brazenly reject Moshe’s overtures, Moshe responds with an unusual request of HaShem[1]. “Do not turn to their Mincha, I did not even use a donkey of theirs, nor did I do evil to any of them.” What does it mean to not accept their Mincha? 

Where do we find such a punishment, and why is that specifically what they deserve here?

Rashi questions which Mincha is the Pasuk referring to, and brings two explanations[2]. The first is that it is referring to the Ketores which is to be brought the next day as a test who is the real Cohen Gadol. Moshe is asking HaShem to disregard the Ketores they will bring. There are three issues that the commentaries on Rashi have with that[3]. First, where do we find that Ketores is called a Mincha? Second, why is Moshe concerned that HaShem will accept it? The whole point was that through the Ketores, Aharon will be chosen. Third, whom is Moshe speaking to? The reading of the Pasuk seems to be referring to Dasan and Aviram. But that is difficult since they were never part of the trial of the Ketores. Because of these questions Rashi brings a second explanation based on the Midrash.

Rashi’s second explanation is that the Mincha is not referring to the Ketores, but to the Korban Tamid that was brought every day. That resolves all three questions. First, there is a Mincha with the Tamid. Even more, the Tamid is also called a Mincha. In addition, since every person in Klal Yisrael had a portion in the Tamid, Moshe can be addressing Dasan and Aviram, and requesting that their portion in the Tamid be rejected. That addresses the last two questions.

But even though the second explanation fits into the words of the Pasuk, conceptually it needs understanding. How does such a rejection of a portion of the Korban Tamid work? And why is the proper punishment for their rebellion and Chutzpah the disregard of their portion of the Tamid? Why is this the punishment that Moshe requests?

If we look at the Midrash itself, we can begin to resolve some of these questions[4]. Moshe says, “HaShem I know they have a portion in the Mincha that is brought with the Tamid. This is brought from all of Klal Yisroel, and since they separated from Your sons, do not look towards their portion, and let the fire abandon it, and not consume it.”

The Midrash explains that as a consequence of separating from the community, they cannot have a portion in the Korban of the community. It is not just that they separated from the community. This separation is specifically relevant to Korbanos. Korach’s claim that Moshe’s choice of Aharon as Cohen Gadol was erroneous, was the basis of this dispute. If Dasan and Aviram agreed with that position, then how could they allow their portion of the Korban to be brought by Aharon? Therefore, Moshe is only asking that HaShem follow their own logic to its conclusion, and deprive them of the benefit of the Korban that Aharon and his sons bring.

The Chasam Sofer explains Moshe’s request in the following way[5]. Dasan and Aviram did not accept Aharon as a Cohen. What saved Klal Yisroel from the punishment after the Eigel was the construction of the Mishkan, and the Korbanos brought in the Mishkan. Aharon was specifically the one to perform this atonement. Since they do not accept Aharon and his Korbanos, they were already worthy of punishment earlier. Therefore, do not accept their portion of the community Korbanos since they do not accept Aharon. And therefore they already deserve to be punished since the time of the Eigel.

But why specifically the Mincha of the Tamid, and not the Tamid itself? The Netziv in Parshas VaYikra[6] clarifies the need for four types of Mincha. He explains that the Mincha is brought as a Korban for a sin not of actions but of Midos. Based on Rishonim he explains there are four basic families of Midos. Each one of the Menachot represents a different type of repentance for a different characteristic. The sin of Korach and his congregation was one of Midos. Therefore, the proper Korban if they desired to do Teshuva, would be a Mincha. But of all the Korbanos, the one of Midos has to be the most heartfelt. One can change an action, and bring a Korban for it, even if internally you have not completely changed. But a change in Midos, requires sincerity. That is why the Pasuk in Yeshayahu says, “Do not accept a false Mincha”.[7] When Moshe says that HaShem should not accept their Mincha; he is saying that HaShem should not accept their Korban Mincha, since based on the way they treated him, their request would be insincere.

The Ohr HaChaim expands this idea[8]. He asks, “How can Moshe Rabbeinu daven that a Korban not be accepted?” It would seem to be asking HaShem to go against His own principles. But there is a concept of Hefker Bais Din. The Bais Din in the proper circumstances can take away someone’s processions, even if it does not seem to follow the regular laws of the Torah. So too, Moshe can remove someone’s merit, even if it would seem that they should not lose it. So even though on some level the Korban should ‘work’, Moshe can override that.

The Sefer Yismach Moshe[9] explains how their portion of the Korban Tamid was delineated. The basic understanding of a Korban is that it is a stand-in for the physical person who did the sin. The sinner performs Semicha – leaning with his entire body on the Korban. That is a way to transfer his physical self to the Korban. Then his spiritual will and the physical life of the Korban are sacrificed. In a Korban Tzibur, each person’s will is embodied in a certain aspect of the Korban. Since the sinners here did not want to be part of the community, the portion of the Korban that was financially theirs through the half-Shekel, was not consumed as a part of the Korban.

There is one last issue, which is that this Midrash seems contradict a Gemarra. In Chagigah[10] we learn that as a result of the Sin of the Meraglim, the Korban Tamid was not brought in the desert. So what is Moshe saying, that they should not have a portion in the Tamid? There wasn’t one! Rashi there says that the Gemarra means that Klal Yisroel could not bring the Korban, but the Leviim did bring it, since they did not sin. So if Moshe is addressing Korach, then it could work. But most Mefarshim write that he was addressing Dasan and Aviram? The Chasam Sofer answers that since they felt that they should be the Cohanim, according to their logic they did not deserve the punishment. Even more, as they said to Moshe, “It is your fault that we are not entering Eretz Yisroel”. So they felt that they should already be bringing the Korban Tamid. But since the Leviim were bringing the Korban and they did not accept that need, Moshe is justified in saying to HaShem to not accept their Korban. Moshe is addressing them according to their logic.

Based on the synthesis of Mefarshim presented here, we can see that Moshe’s request of HaShem was an exact punishment based on the specific circumstances of their sin.

[9] ספר ישמח משה – פרשת קרח דף סד/א – ועדיין קשה במה נברר חלקם, הא קיימא לן (עירובין ל”ז ע”ב) בדאורייתא אין ברירה, ואם כן בשעת עבודות חלקם חל על הכל, וגם אחר כך מהיכי תיתי נימא שזה חלקם דבמה נברר חלקם. אך לא קשה מידי, דהנה כבר פירשתי (לעיל פרשת וירא) בפסוק (בראשית כב ח) אלקים יראה לו השה לעולה בני. דכל ענין הקרבנות שיועיל הקרבת הבהמה, נצמח מהענין של יצחק שהאבות הן היו פועל דמיוני בכל הדברים. והנה במדרש תנחומא פרשת צו (סי’ י”ג) נתבאר זה, וז”ל, ויקח את האיל וגו’ (שם שם בראשית כב יג), שם הבטיחו הקב”ה שבעת שיעלו בניו עולות, שיקבלם מיד, עד כאן. והנה היה יצחק פועל דמיוני, כשם שנשמתו נכנס באילו והיה נחשב כאלו הוא נקרב, ככה בכל מקריב קרבן, והיינו טעמא דסמיכה בכל כחו בעינן (חגיגה ט”ז ע”ב), והבן. והנה בקרבנות צבור נכנסו ניצוצין מכל נשמות ישראל להקרבן והבן, והנה כל ניצוץ יש לו אחוזה לפי מדריגתו באבר היותר חשוב או היותר שפל. והנה הרשעים בחייהם קרוים מתים (ברכות י”ח ע”ב), כי נעדר מהם נשמה הקדושה, ואלו אין אחיזתם מרושם החיות שבהם רק בדבר שאין הנשמה תלויה, דנפש משיב נפש וכל עוף למינו ישכון (בן סירא י”ג, עיין ב”ק צ”ב ע”ב) והבן. אם כן לא שייך בזה אין ברירה, דקמיה שמיא גליא איזה מקום אחיזתם, והבן.
